Buying or selling a home or a commercial property is easily the most significant transaction many people will conduct during their lifetime. It could also be the most complicated one. Real estate law contains numerous pitfalls for consumers. The process is much simpler when you hire an experienced real estate lawyer to ensure your property rights are protected.
At Chodola Reynolds Binder, we work hard to exceed our clients' expectations in real estate matters. Whether you are a first-time buyer or have previously purchased a home or a property, there can be issues around each transaction. Your Windsor, Ontario, real estate lawyer works to protect your interests and resolve any problems that may come up in a favourable manner for you.
Each real estate transaction in Ontario requires a lawyer to close the deal. It’s no longer necessary for the buyer and seller representatives to go to the local land registry office to exchange documents (hand over the keys to the property) and register the title transfer. With modern electronic registration, specialized software completes the transfer from the lawyers' office. Only lawyers can access the software required, which means anyone who wants to buy or sell real estate must consult a lawyer.
Residential Real Estate Transactions
Our knowledgeable team assists buyers and sellers with the agreement of purchase and sale and completes all necessary closing documents. It is a good idea to have CRB Law review the agreement of purchase and sale (and have your real estate agent add a clause that the offer becomes firm only after your lawyer reviews it). An attorney may spot potential issues that a lay person would miss.
If you are selling your home, include a clause that your home is not officially listed for sale until your lawyer reviews the document. For pre-construction contracts, you have 10 days to change your mind and void the contract (the cooling-off period) by law. Have a lawyer review the agreement of purchase and sale within 10 days to ensure there is no cause for concern in the contract.
We can advise the purchaser about title insurance and negotiate on our clients behalf if any disputes arise before closing.
CRB Law completes the various title and off-title searches to ensure that you can take title to the property free and clear of any liens or other encumbrances. We also calculate the appropriate land transfer taxes and any GST owing. CRB Law will order tax certificates to provide accurate property tax adjustments as of the closing date.
